Authorization of
Waste Management Agent

The current environmental regulations, established in Law 7/2022, of April 8, on waste and contaminated soils, require companies or entities that handle, store, or classify waste to obtain authorization as waste managers.

There are two categories of authorizations based on the type of waste managed:

1. Permit for companies that manage non-hazardous waste.
2. Approval for the management of hazardous waste.

Having these authorizations ensures that your company operates within the legal framework. According to Article 46 of the aforementioned law, operating without a permit is considered a serious offense with penalties ranging from 100,001 to 3,500,000 euros; For hazardous waste, fines can range from 600,001 to 3,500,000 euros.

Moreover, obtaining authorization ensures that your organization will not face setbacks during inspections, as many clients require their suppliers and managers to have this validation. In this way, you indirectly contribute to the economic growth of your own organization.

Authorization acquisition process

First stage: Initial training.
We guide the client in understanding all legal requirements and obligations, ensuring that their facilities comply with current regulations.

Second stage: Preparation of documentation.
Depending on the nature and location of the activity, the preparation of various technical documents will be required, such as environmental impact studies or soil reports, which need to be signed by subject matter experts. It is essential to develop a detailed installation plan that includes technical specifications and any relevant information for the operation site. The LER codes will identify the types and quantities of waste that can be treated, along with a detailed description of the planned activities.

Third stage: Processing requests and tracking approvals.
In the authorization process, different organizations must participate, including those for health, environmental assessment, and civil protection. During this process, additional requirements may arise that must be addressed in a timely manner.

Fourth stage: Obtaining permission.
This is the final stage of the process. After receiving authorization, an annual report is required that includes the treated waste, its quantity, and destination.
